Abstract:

With the development of science and technology, the biometric market is developing rapidly. This paper analyzes the problems of the general rules of biometric technology, including the difficulty of information subjects participating in rule-making, the lack of provisions of general rules, and insufficient legal regulation. Drawing on the provisions of personal information related to biometrics in Europe and the United States and the protection of personal information related to biometrics in China, the paper suggests that the protection of biometric information should be improved and connected with the existing laws. The results show that the top three provinces in the number of cases based on biometric technology are Guangdong Province, Beijing Municipality and Jiangsu Province, with a total of 102 cases, accounting for 52.41% of the total number of cases, among which Guangdong Province tops the list with 75 cases in 10 years, far ahead of other provinces, indicating that the legal regulation of biometric technology is a pressing need. This paper explores a legal regulation path of biometric technology application economic law suitable for China's socio-economic development, intending to realize a healthy, safe, green digital society.
