Abstract:

Protecting intellectual property (IP) in the biotechnology sector is key to innovation, competitiveness, and sustainable development, especially in developing countries such as Vietnam. Purposing of this paper is to analyze the challenges Vietnam faces in protecting biotechnology IP and propose solutions to improve the legal and institutional framework. The study provides an overview of the current status of IP protection in Vietnam and highlights issues related to enforcement, patenting, and IP awareness among biotechnology companies. Case studies of IP disputes identify key obstacles, including an inadequate legal framework, limited enforcement options, and the risk of IP theft in a rapidly globalizing market. Drawing from successful international models, the paper suggests a comprehensive approach to reform Vietnam's IP protection system. Key recommendations include legal reforms, capacity building for enforcement agencies, promoting public-private partnerships, and enhancing international cooperation. Strengthening IP protection is essential not only for fostering innovation in Vietnam’s biotechnology sector but also for securing its competitiveness in the global market.
